Agreement Between User and Dog Boutique Store

Health Guarantee

Puppies are living animals and, like all animals, may develop health conditions during their lives.

Any written health guarantee or health commitment provided with a puppy purchase will govern the specific health coverage applicable to that puppy.

Customers are responsible for obtaining appropriate veterinary care and following their veterinarian's recommendations regarding vaccinations, parasite prevention, nutrition, exercise, spaying or neutering, and general care.

Nothing in this section limits any express written warranty or health guarantee specifically provided with a puppy purchase or any rights that cannot legally be excluded.

Weight and Size Guarantee

We provide an estimate of a puppy's weight and/or expected adult size, but such estimates are not guaranteed unless expressly stated otherwise in a written agreement.

Several factors can influence a dog's adult weight and size, including genetics, breed, age, activity level, nutrition, exercise, and whether the dog is spayed or neutered.

Customers understand that estimated adult size and weight may vary and that an exact adult size or weight cannot be guaranteed.

Pet-Only / No Breeding

All puppies are sold as companion pets and not for breeding purposes.

Dog Boutique Store and PuppiesAndCats.com do not sell puppies for commercial breeding purposes.

By purchasing a puppy through PuppiesAndCats.com, the customer acknowledges that the puppy is being purchased as a companion pet and agrees not to use the puppy for commercial breeding purposes.

Customers are responsible for providing appropriate care, housing, nutrition, veterinary care, identification, licensing, and humane treatment throughout the puppy's life.

Customer Responsibilities

Customers are responsible for ensuring that their home, housing arrangements, local rules, and personal circumstances permit them to own a puppy.

Customers are responsible for providing appropriate food, water, shelter, veterinary care, exercise, training, grooming, supervision, and companionship.

Customers are also responsible for complying with applicable local licensing, vaccination, leash, housing, and animal-control requirements.

Delivery and Transportation

PuppiesAndCats.com may arrange or coordinate delivery or transportation services for purchased puppies.

Delivery dates, times, locations, transportation methods, and related fees may vary depending on the puppy, destination, transportation requirements, weather, transportation restrictions, and other circumstances.

Delivery estimates are not guarantees unless expressly confirmed in writing.

Customers are responsible for providing accurate delivery information and being available to receive the puppy at the agreed-upon location.

Additional transportation requirements or documentation may apply depending on the destination.

PuppiesAndCats.com may contain links to other websites (“Linked Sites”).

AGREEMENT TO MANDATORY INDIVIDUAL ARBITRATION & CLASS ACTION WAIVER

PLEASE READ THIS CAREFULLY AS IT AFFECTS YOUR RIGHTS. INSTEAD OF SUING IN COURT, YOU AND DOG BOUTIQUE STORE AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DISPUTES COVERED BY THIS SECTION WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION. THERE IS NO JUDGE OR JURY IN ARBITRATION, AND COURT REVIEW OF AN ARBITRATION AWARD IS LIMITED. YOU AND DOG BOUTIQUE STORE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

This agreement to arbitrate is intended to be broadly interpreted and includes, to the maximum extent permitted by law, disputes and claims arising out of or relating to any aspect of the relationship between you and Dog Boutique Store or PuppiesAndCats.com, including claims relating to purchases, warranties, health guarantees, representations, advertising, delivery, services, contracts, torts, statutes, fraud, misrepresentation, or any other legal theory.

You and Dog Boutique Store agree that the Federal Arbitration Act (“FAA”) applies to this arbitration provision and governs its interpretation and enforcement to the extent applicable.

Unless you and Dog Boutique Store agree otherwise in writing, arbitration shall be administered by the American Arbitration Association (“AAA”) pursuant to its applicable Consumer Arbitration Rules and conducted by a single neutral arbitrator.

THIS AGREEMENT DOES NOT ALLOW CLASS ARBITRATIONS. ARBITRATION MAY ONLY BE CONDUCTED ON AN INDIVIDUAL BASIS, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Unless both parties agree otherwise in writing, the arbitrator may not consolidate the claims of more than one individual or preside over any class, collective, consolidated, or representative proceeding.

Each party shall be responsible for its own attorneys' fees, experts, and witness costs, except as otherwise provided by applicable law or the applicable arbitration rules.

This arbitration agreement does not prevent either party from bringing an issue to the attention of a federal, state, or local government agency where permitted by law.

Either party may bring an individual action in small-claims court if the claim qualifies for small-claims court and applicable law permits such action.

Any proceeding to enforce, confirm, modify, or vacate an arbitration award may be brought in a court of competent jurisdiction as permitted by applicable law.

If any portion of this arbitration agreement or class-action waiver is determined to be unenforceable, the remaining portions shall remain in effect to the maximum extent permitted by law.

This arbitration provision shall survive termination of these Terms to the extent permitted by law.

Liability Disclaimer

The information, software, products, and services included in or available through PuppiesAndCats.com may occasionally include inaccuracies or typographical errors.

Changes may periodically be made to the information contained on the Site.

Dog Boutique Store and/or its suppliers may make improvements or changes to the Site at any time.

Dog Boutique Store and/or its suppliers make no representations regarding the suitability, reliability, availability, timeliness, or accuracy of general information, software, products, services, or related graphics contained on the Site for any particular purpose.

To the maximum extent permitted by applicable law, general Site information, software, products, services, and related graphics are provided on an “as is” and “as available” basis.

Nothing in this section limits any express written warranty or health guarantee specifically provided with a puppy purchase or any rights that cannot legally be excluded.

To the maximum extent permitted by applicable law, Dog Boutique Store and/or its suppliers will not be liable for indirect, punitive, incidental, special, consequential, or other damages arising out of or relating to the use of the Site, delay or inability to use the Site, provision or failure to provide services, or information, software, products, or services obtained through the Site, except to the extent such limitation is prohibited by applicable law.

If you are dissatisfied with any portion of the Site or these Terms, your remedy is to discontinue using the Site, except where applicable law provides otherwise.

Termination / Access Restriction

Dog Boutique Store reserves the right, in its discretion and to the maximum extent permitted by law, to terminate or restrict your access to PuppiesAndCats.com and related services at any time when reasonably necessary, including for violation of these Terms or misuse of the Site.

To the maximum extent permitted by law, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

You agree that your use of the Site is unauthorized in any jurisdiction where these Terms cannot legally be given effect.

Nothing in these Terms limits Dog Boutique Store's right to comply with governmental, court, or law-enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Dog Boutique Store in accordance with applicable law.

No Joint Venture, Partnership, Employment, or Agency

You agree that no joint venture, partnership, employment, franchise, or agency relationship exists between you and Dog Boutique Store as a result of these Terms or your use of the Site.

Severability

If any provision of these Terms & Conditions is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

A printed version of these Terms and electronically provided notices may be admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other business records, to the extent permitted by law.

Customers agree that puppies purchased through PuppiesAndCats.com are intended to be companion pets and not used for commercial breeding operations.
